Terms of
Service.
The terms that govern your use of this website and any automation work we carry out for you.
1. These terms
These terms govern your use of gowinthe-ai.tech and any services provided by Gowin The AI (“we”, “us”). By using this website you accept them. If you do not accept them, please stop using the site.
A signed proposal, statement of work or service agreement for a specific project takes precedence over these terms wherever the two conflict. These terms fill the gaps; they do not override what we have agreed with you in writing.
2. What this website is
This website describes services we offer. Nothing on it is a binding offer or a guarantee of a particular outcome. Prices, timelines and service descriptions shown here are indicative and may change without notice. A project becomes binding only when we have both agreed its scope, price and timeline in writing.
3. Enquiries and quotes
Submitting the contact form does not create a contract or oblige us to take on your project. We may decline work, including where we judge that automation would not deliver enough value to justify its cost — we would rather tell you that than take the engagement.
Quotes we issue are valid for 30 days unless stated otherwise, and are based on the scope described at the time. A material change in scope may change the price and the timeline.
4. Our services
We build AI and automation systems — chatbots, voice assistants, lead and sales automation, CRM, integrations, websites and related consulting. Each engagement is defined by its own statement of work, which sets out deliverables, milestones, acceptance criteria and fees.
Timelines
The “2–4 weeks” figure used across this website is a typical delivery window for a standard scope, not a contractual commitment. Actual timelines depend on scope, the complexity of your existing systems, and how quickly we receive access, content and decisions from you. Delays caused by late input from your side extend the timeline accordingly.
What we need from you
- Accurate information about your business and your existing systems
- Timely access to the accounts and tools the project depends on
- A named person who can make decisions and give feedback
- Review and sign-off at the agreed milestones
5. Fees and payment
Fees, the payment schedule and the currency are set out in your statement of work. Unless agreed otherwise:
- Invoices are payable within 15 days of issue
- All fees are exclusive of applicable taxes, including GST, which is added where it applies
- We may pause work on overdue accounts after giving you written notice
- Recurring monthly fees continue until cancelled in line with section 8
We do not take payments through this website. Invoices are issued and settled directly with you by the method stated on the invoice.
Refunds
Fees for work already performed are non-refundable, because the time has already been spent. If we cancel a project before delivery for reasons within our control, we will refund any fees paid for work not yet carried out. If you think something has gone wrong, email us first — we would rather resolve it directly.
6. Intellectual property
What you own
You own your data, your content, your brand assets, and — once you have paid in full — the custom deliverables we build specifically for you under the statement of work.
What we own
We retain ownership of the underlying tools, frameworks, libraries, templates and know-how we bring to the project, including anything we developed before the engagement or independently of it. Where those components are embedded in your deliverables, we grant you a perpetual, non-exclusive, worldwide licence to use them as part of those deliverables.
We may describe the general nature of the work in our portfolio. We will not name you as a client or publish identifying details without your written permission.
Third-party components
Projects commonly rely on third-party services and AI models. Those remain subject to their own licences and terms, and their pricing and availability are outside our control.
7. Acceptable use
You agree not to use this website or our services to:
- Break any applicable law or regulation
- Send spam, or messaging that breaches communications or consent rules
- Infringe anyone’s intellectual property or privacy rights
- Attempt to gain unauthorised access to our systems, or probe, scan or test their security
- Introduce malware, or otherwise interfere with the service’s operation
- Deploy systems we build in ways designed to deceive, harass or defraud people
You are responsible for ensuring that the way you use an automation we build — particularly anything that sends messages to your customers — complies with the consent and marketing rules that apply to you.
8. Ending an engagement
Either of us may end an ongoing engagement by giving 30 days’ written notice. Either of us may end it immediately if the other commits a material breach and fails to fix it within 14 days of being told about it.
On termination, you pay for work performed up to that date, we hand over the deliverables you have paid for, and we will provide a reasonable export of your data on request.
9. Warranties and what we do not promise
We will perform our services with reasonable skill and care, in line with professional standards. We will fix defects in our deliverables that you report within 30 days of delivery, at no extra cost, where they result from our work.
We do not guarantee specific business outcomes. Figures on this website such as “10x faster” or “50% savings” describe results some clients have seen. They are illustrative, not a promise about your business. Revenue, lead volume and cost savings depend on factors outside our control.
We also do not warrant that AI-generated output will always be accurate. AI systems can produce incorrect results, and any system we build that makes consequential decisions should have human review. Beyond what is stated here, the website and services are provided “as is” to the fullest extent the law allows.
10. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our total liability arising out of or in connection with an engagement is limited to the total fees you paid us for that engagement in the 12 months before the claim arose. Neither of us is liable to the other for indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data, however caused.
11. Confidentiality
Each of us will keep the other’s confidential information confidential, use it only for the engagement, and protect it with at least reasonable care. This does not apply to information that is already public, was already known without obligation, or must be disclosed by law. These obligations continue for 3 years after the engagement ends.
12. Governing law
These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising from them. Before starting formal proceedings, we both agree to try in good faith to resolve the dispute by discussion — email contact@gowinthe-ai.tech and we will engage with it properly.
13. General
- If any provision is held unenforceable, the rest remains in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign your rights under these terms without our written consent.
- Nothing here creates a partnership, joint venture or employment relationship between us.
14. Changes
We may update these terms. The version published on this page at the time you use the site is the one that applies. Material changes affecting an ongoing engagement will be communicated to you directly rather than posted silently.
